The land you want to transfer into your names needs to surveyed and checked its actual size before proceeding the acquistion of the title. In this get a professional and registered surveyor to carry out a topographical survey of the land and comfirm the size and shape of the land as indicated on the title. The survey will open up the boundaries and mark stones of the land and give you a final report.
PAYEMENT OF THE LAND TITLE.
The buyer must be aware that the payment rate for the title is a legitimate requirement and the seller must clear any pending debts before proceeding into a new transaction with the new buyer. The seller must present a clearance certificate to the buyer before its transfered into the buyer including the original land title, transfer forms and consent to transfer. The process is executed by both parties. These documents will be organised and completed following the consent and signature of the commissioner of lands.
REQUIREMENTS FOR TRANSFER.
When the registration processes is done, the legal possesion of land/site legally changes hands from there and then and you have an independent ownership of the property.
For a legal transfer ownership to take place,one needs;
* The original title deed of the land/ste.
* Original stamp duty assessment forms and receipt.
*Duly stamped transfer documents.
*Stamp duty valuation.
*Original land rates clearance certificates.
*Consent to transfer plus application for registration
